This Terms and Conditions sets forth the agreement for the Panel Members of SurveyReal, a market research panel owned, registered and operated by Strategic Research and Development Center, Inc. (“STRAND-Asia”, “we”, “us” or “our”).

Section 1. Acknowledgement and Acceptance

PLEASE READ CAREFULLY. By completing the registration process as Panel Member of SurveyReal, you accept and agree to all the provisions hereunder, including our Privacy Policy and all other associated or referred documents, policies, rules and regulations, which comprise the entire Terms and Conditions.

This Terms and Conditions establish the relationship and the respective right and obligations of STRAND-Asia and the Panel Member(s) who are duly authorized by SurveyReal to register as online survey respondent(s), subject to the provisions set forth in Section 3 hereof.

STRAND-Asia provides consumer opinions and activities through Market Research Survey(s) (“Survey”) created and posted at SurveyReal or in such other websites as may be specified. All Panel Members voluntarily respond to given surveys, but only the responses/information gathered from qualified Panel Members are aggregated, processed and analyzed by STRAND-Asia, and/or our client(s) for the benefit of companies and/or organizations who engaged our services for such purpose.

Section 2. Definition of Terms

The following terms are defined according to their use and application in this Terms and Conditions:

“Account” means the personal account of a panel member who has activated his/her registration with SurveyReal by clicking on the link of a confirmation email sent to him/her and thereby agreeing to its terms and conditions. Its access allows a panel member to edit, add or delete personal information and check points or redeem rewards.

“Client” means any individual or organization that requests, commissions or subscribes to all or any part of a research project.[1]

“Data” refers to any and all information, including personal information and sensitive personal information, among others, collected by, or submitted to STRAND-Asia from clients or non-clients, employees or any data subject, individual and entities.

“Minimum Data Required” means the minimum data required to perform profiling on a significant sample which includes the panel members’ full name, email address, password, gender, birthdate, address, contact number, and current work.

“Panel” means a group of individuals who voluntarily registered with SurveyReal in order to participate in surveys.

“Panel Member” means an individual participant of SurveyReal.

“RealPoints” means the reward that a panel member receives for completing a survey.

“Registration Form” means a prerequisite form that needs to be accomplished and submitted by a panel member to qualify as such of SurveyReal.

“Research” or “Market Research” means an activity involving data gathering through surveys of any type, on any topic, which aims to study, among others the behavior and opinions of customers or individuals, conducted by SurveyReal.

“Service(s)” means the services offered by SurveyReal which includes surveys, product testing, and exchanges of opinions, among others.

“STRAND-Asia” refers to the company that is the registered owner, creator and operator of SurveyReal.

“Redeem” means the act of claiming specific reward(s) by a panel member using his/her points that were acquired over the course of his/her membership with SurveyReal.

Section 3. Eligibility of Panel Members

All the following minimum qualifications are required to qualify and participate as Panel Member:

1. Must be at least eighteen (18) years old;
2. Must be a resident of the Philippines;
3. Must not be working and/or affiliated with any market research company;
4. Must successfully complete the entire registration process;
5. Must have a working email address and would be willing to receive email notifications from SurveyReal; and
6. Must have their own mobile number.

 

Section 4. Obligations of Panel Members

For strict compliance, all Panel Members:

1. Must provide true, correct and accurate personal information or responses, and must keep personal account information updated at all times by accessing his/her account to personally effect the necessary update or changes;
2. Prohibited to create and maintain duplicate, dummy, or fake panel accounts;
3. Prohibited to disclose account access to anyone;
4. Must fully cooperate and participate to any surveys, polls and all other data collection platform including those that were sent by the panel through email or other electronic means;
5. Must observe strict confidentiality at all times, such as when participating in any surveys or polls;
6. Must be of good moral character and accountable to personal actions, thus prohibited to publish or post defamatory, discriminatory, false, fraud, fake, inaccurate or any other malicious information, messages, comments, remark, note or statement about STRAND-Asia, Third Party Clients, Affiliates, and/or any other entities and matters relative to their products and services, in any printed or electronic materials;
7. Must properly observe and respect trademark, copyright, legal entity rights and other property and propriety rights, thus must use the panel accounts only for its intended purpose, prohibiting personal and/or commercial use thereof, such as advertising and marketing for personal benefit and gain; and
8. Must strictly abide by this Terms and Condition and all its pertinent provisions.

 

Section 5. Obligations of STRAND-Asia

STRAND-Asia is committed to:

1. Provide the official platform where the panel are expected to log in and access the surveys;
2. Provide a Frequently Asked Questions (FAQs) page;
3. Provide necessary assistance for any issue or complaint regarding the official platform, access, services or any other matters related hereto;
4. Regularly check and monitor the quality and validity of panel members and their respective responses;
5. Implement necessary measures to protect information provided by panel members, and to keep confidential their personal data;
6. Treat all information provided by the panel members with strict confidentiality and keeping them anonymous at the same time, although panel members may have the option to expressly waive the anonymity in some instances, including the set of responses given by the panel or otherwise from the sample used for research data, relating to surveys and market research;
7. Keep and maintain the official platform and websites operational at all times, thus STRAND-Asia and/or SurveyReal will not be responsible for interrupted and/or malfunctioned service due to faulty internet connection, device malfunction or any other external causes, further that these incidents do not give any right to reimbursement and/or reward;
8. Publish the contributions of panel members for circulation, provided that the same has been approved and consented to by the concerned panel members;
9. Identify and inform panel members on the eventual contraindications of products to be tested (e.g., allergies, minimum age, pregnancy);
10. Contact any panel member should violation of the Terms and Conditions occur and hold such panel member duly responsible, upon due notice and hearing, to STRAND-Asia and/or any Third-Party Client for any damages that may have been caused or incurred, to which the panel member agree to accordingly compensate;
11. Communicate to panel members intended changes through printed, online, or any practicable means, and consult the same of such changes, without necessarily waiving the right of SurveyReal to modify the Service and the current conditions without prior notice and consultation;
12. Permanently and immediately delete data of unsubscribed members from the system. (Technically, the system will temporarily place the data to its recycle bin and will be permanently removed after 7 days.);
13. Provide relevant reward options to its members and process redemption of rewards within 15 calendar days upon submission of request;
14. Strictly enforce this Terms and Condition as well as our Privacy Policy.

 

Section 6. Account Management

A Panel Member is required to register and set up an official account with SurveyReal. Upon registration, he/she will be issued by an official account, whose management, use, security and confidentiality shall be the responsibility of the Panel Member. Only the official account of the Panel Member may be used to gain access and participate in any survey, designated email address and password will be required.

A Panel Member is prohibited from assigning, lending, or disclosing his/her designated email address, password and other credentials which are all considered confidential. STRAND-Asia shall assume no responsibility for any sustained damage or injury of any form associated with the negligence of the Panel Member with regard to designated email address, password and other credentials.

Section 7. Data Management

All information provided to us by Panel Members which includes personal information and responses to surveys, among others, shall be counted and referred to as “Data”.

If copyright or any other intellectual property rights subsist in any of the Data, to the largest extent permitted by applicable laws, the Panel Member hereby voluntarily assigns to STRAND-Asia, with full title guarantee, its copyright and all other intellectual property rights, including the right to reproduce on any media such as print and/or electronic, and to represent by any means, including electronic communications networks. As part of ownership rights thereof, STRAND-Asia shall select, modify and edit the contents of the Data, as it deemed appropriate. The panel member shall not exercise intellectual rights over said Data. The Panel Member shall hold STRAND-Asia or any third party free from harm or any claims, to the extent permitted by applicable law, and shall waive cause the waiver of all moral and economic rights over said Data.

The Panel Member shall not at any time knowingly provide any false Data or other similarly inaccurate information to STRAND-Asia. Thus, to maintain the accuracy and the quality of Data, STRAND-Asia may contact the Panel Member through e-mail, mail, telephone, and any other practicable means to confirm, follow-up, and check the quality of the Data provided. The Panel Member hereby gives his/her expressed consent to be contacted upon completion of registration.

Section 8. Prohibited Acts

The Panel Member agrees to only use our services for lawful purposes and is prohibited from performing any of the following acts:

1. Any acts that violates any applicable laws, regulations or ordinances, or promotes the violation thereof;
2. Any acts that harasses, offends, discriminates, causes nuisance or targets people of a particular race, religion, or gender;
3. Any actions that violates the copyright or any other intellectual property rights of STRAND-Asia, other panel members, and third parties;
4. Any acts which intends to offend other panel members or a third party;
5. Any actions which may discriminate other panel members and third party;
6. Any action which disrupts and disturbs SurveyReal’s operations;
7. Any acts which can result to providing false registration or falsified or misleading data to STRAND-Asia;
8. Any acts resulting and/or suggesting duplication of membership registrations for and/or by the same person;
9. Disclosing or divulging the contents of a survey without the expressed written consent of STRAND-Asia or its clients including taking pictures, video, or screenshot of any of the SurveyReal’s content, discussing among families/friends, among others;
10. Illegal and unauthorized use of e-mail address or password;
11. Illegal and unauthorized use of the website for profit or any other purposes;
12. Any fraudulent act or manipulative scheme;
13. Any acts that are deemed to be inappropriate, injurious and detrimental to STRAND-Asia.

 

Section 9. Communications Media

The Panel Member shall use only the latest and updated mobile number and e-mail address that were provided during registration when sending and/or receiving printed and/or electronic correspondence to and from STRAND-Asia. Further, the Panel Member shall reply and/or acknowledge within reasonable time whenever he/she receives a communication from STRAND-Asia.

STRAND-Asia shall not be liable to the Panel Member for the loss and damage caused by non-delivery/receipt of any printed and/or electronic correspondence to and from STRAND-Asia.

Section 10. Points, Rewards, and Payment

As a reward for completing the survey or task, STRAND-Asia may provide Panel Members with RealPoints which may be used to redeem cash or gift item.

The amount of RealPoints that a panel member may earn depends on the survey or task they participated at, which varies from time to time, as stated in the announcement section of the panel member’s dashboard. RealPoints are determined and assigned by STRAND-Asia according to several factors considered and its internal policies.

Gift items are subject to availability of stocks. Thus, STRAND-Asia reserves the right to assign, replace or substitute them with other item of similar value without prior notice. STRAND-Asia sets forth the methods, procedure and policy with regard to gift items, including specific period of validity and redemption by Panel Members.

The withdrawal of membership results in the forfeiture of any existing, unclaimed, or unrealized points, rewards or payments, unless otherwise expressly exempted or specified. Additionally, if the membership of a Panel Member has been terminated for violations of this Terms and Conditions, under reasonable instances and in accordance with the provisions under Section 12, any existing, unclaimed, or unrealized points, rewards or payments shall also be forfeited.

Gift item, reward or cash payment redeemed using earned points by Panel Members shall be sent to the panel member’s registered mobile number or email address on account or via third party settlement, such as e-Rewards or fund transfer through e-Wallet among others, upon expressed agreement and request of the panel member, provided that third party settlement account was duly registered. Further, any flaw or mistake in the registration information of panel member causing delivery error or non-delivery, STRAND-Asia will not liable for such mistake, inadvertence, or negligence. In addition, it cannot be compelled or obligated to resend, reissue or reimburse the gift item, reward or cash payment, nor will the points be replaced or reimbursed. STRAND-Asia will not be liable to any failed transaction caused by the Panel Member.

Undelivered or uncredited gift item, reward or cash payment must be reported immediately to STRAND-Asia and/or third-party settlement through any practicable means. If the Panel Member fails to notify STRAND-Asia and/or third-party settlement within a period of fifteen (15) calendar days from the time of request for redemption, STRAND-Asia will not be liable for such undelivered or uncredited gift item, reward or cash payment, notwithstanding any flaw or mistake in the transaction caused by any party.

STRAND-Asia reserves the right to cancel/forfeit points, rewards, gift if the Panel Member falsified or provided inaccurate information, or if violation of any of the provisions of this Terms and Conditions has been committed by the panel member.

Section 11. Voluntary Withdrawal of Membership

Panel members may withdraw their membership at any time by clicking the “Unsubscribe” button that is present in the email notification of SurveyReal or go to “My Account” in your Dashboard and click “Unsubscribe”. Withdrawal of membership takes effect immediately.

All accumulated points must be used or redeemed before the withdrawal takes effect, otherwise the same shall be deemed forfeited. No further transactions, such as redemption, exchange, or any other matters related to points, rewards or cash payment will be entertained upon withdrawal of membership.

Section 12. Termination of Membership

STRAND-Asia reserves the right to terminate the membership of a Panel Member, with or without their consent under the following circumstances:

1. If any of the prohibited acts mentioned in Section 8 was committed;
2. If any of the provisions of this Terms and Conditions was violated; and
3. If the panel member has been inactive or has not participated in any activity, survey or poll for at least 2 months.

STRAND-Asia will e-mail a Notice of Termination of Membership to the Panel Member should any of the foregoing instances occur. Upon termination of membership the panel member will no longer be entitled to any benefits and privileges, including the forfeiture of points, rewards, gift consistent with the provisions of this Terms and Conditions.

Section 13. Personal Data

All information, whether personal or otherwise that were submitted by Panel Members to STRAND-Asia will be collected, processed and kept in accordance with our Privacy Policy, Data Privacy Act of 2012, and other applicable laws and regulations.

The Panel Member agree and undertake to abide by our Privacy Policy and any other pertinent laws on data privacy. Further, that he/she consents thereto with regard to the collection, processing and safekeeping, including the management of all data and/or information. Panel members are required and are assumed to have read and understood our Privacy Policy before providing any information.

STRAND-Asia waives any and all liability relative to surveys found on clients and/or third-party websites. We cannot be held liable for any loss, damage or injury of any form that may have been caused by said websites.

Section 14. Suspension or Discontinuation of SurveyReal

STRAND-Asia may, at its sole discretion, and at any time, temporarily or permanently suspend or discontinue its business/service of SurveyReal even without prior notice. STRAND-Asia assumes no responsibility for any loss, damage or injury of any form caused to the panel members by said suspension and/or discontinuation of business/service.

Section 15. General and Miscellaneous Provisions

If any one or more of the provisions or part thereof contained in this Terms and Conditions should be or become invalid or unenforceable due to any reason or reasons, this will not in any way affect or impair the validity or enforceability of the remaining provisions hereof.

STRAND-Asia reserves the right to amend and/or modify the foregoing Terms and Conditions at any time without prior notice. Further, amendments and/or modifications required by law or any competent authority shall likewise take effect immediately without prior notice.

This Terms and Conditions does not in any way create an Employer-Employee Relationship between STRAND-Asia and the Panel Members.

No Panel Members were forced to participate and provide data/information. All Panel Members have voluntarily participated and provided data/information to STRAND-Asia, its affiliates, subsidiaries and/or clients.
