This Privacy Notice is published in compliance with the requirements of Republic Act No. 10173, otherwise known as the “Data Privacy Act of 2012”.

Privacy Statement

Strategic Research and Development Center, Inc. (the “STRAND-Asia”) values the data privacy rights of our clients and non-clients alike pursuant to the provisions of Data Privacy Act of 2012 (the “DPA”), including its Implementing Rules and Regulations and all other applicable laws and regulations on data privacy.

We warrant full protection and privacy of all the data that we collect, whether personal, sensitive, confidential or otherwise. Accordingly, all data are collected and processed in accordance with the principles of transparency, legitimate purpose and proportionality of the DPA, and such other principles in collection, processing and retention of data as required by applicable laws, including the International Code on Market, Opinion and Social Research and Data Analytics of the International Chamber of Commerce (ICC) / European Society for Opinion and Marketing Research (ESOMAR). We are committed to conduct our business and provide services without compromising data privacy rights of data subjects.

Definition of Terms

Data refers to any and all information, including personal information and sensitive personal information, among others, collected by, or submitted to STRAND-Asia from clients or non-clients, employees or any data subject, individual and entities.

Data Subject refers to an individual whose personal information is processed.[1]

Personal Information refers to any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information or when put together with other information would directly and certainly identify an individual.[2]

Sensitive Personal Information refers to personal information:

1. About an individual’s race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations;
2. About an individual’s health, education, genetic or sexual life of a person, or to any proceeding for any offense committed or alleged to have been committed by such person, the disposal of such proceedings, or the sentence of any court in such proceedings;
3. Issued by government agencies peculiar to an individual which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and
4. Specifically established by an executive order or an act of Congress to be kept classified.[3]

Consent and Acceptance of Terms

PLEASE READ CAREFULLY. By voluntarily providing your data to STRAND-Asia, you expressly authorize and consent to the collection, use, processing and transfer or sharing of said data according to valid and legitimate purpose. Likewise, STRAND-Asia presumes that you have read, understood and agreed to our Privacy Policy before providing your data.

Further, you expressly authorize and consent to the sharing of your data to all government agencies in their legitimate exercise of regulatory function under applicable laws and regulations. Additionally, to our subsidiaries, affiliates, clients and/or other agencies and entities as permitted by law. Any transfer, sharing or outsourced processing of data will be carried out in full compliance with applicable laws.

Purpose and Use

All the data provided to us shall be deemed and shall remain the property of STRAND-Asia. Thus, we shall be free to use and share the same for any purpose, to the fullest extent permitted by applicable laws. All data are used for the efficient achievement of the purpose for which they were provided.

The data that STRAND-Asia collects and shares, shall be used for legitimate purpose only such as: research, analysis, testing, study, assessment, evaluation, survey, or such other purposes intended and as provided. Access of data collected shall be limited to authorized officers or employees only. Additionally, data sharing with our affiliates, subsidiaries, or clients is for the same legitimate purposes mentioned, upon the expressed consent and authority of concerned individuals, and as permitted by applicable laws.

All the data we collect are not and shall never be sold for economic and proprietary purposes. The data collected are in line with our services of providing consumer opinions and activities through market research or study, which is achieved through analysis and data collection from our data subjects or panel members.

In general, among the purposes of our data collection are as follows:

1. To conduct regular business of providing services which include: studies, researches, surveys, and polls among others;
2. To facilitate the creation and maintenance of panel membership of data subjects;
3. To verify the identities of panel members and all other data subjects;
4. To filter, select and qualify panel members relative to survey, poll, or other activities;
5. To evaluate, monitor, review, develop and improve our business and services;
6. To prevent, detect or investigate the safety and security of data collected, services provided and/or data breach;
7. To pursue the legitimate interest of STRAND-Asia, its subsidiaries, affiliates or clients; and
8. To comply with contractual obligations, regulatory requirements, applicable laws of the Philippines, including foreign jurisdictions.

STRAND-Asia obtains data in various ways including the following:

1. Voluntary registration and submission of any application/registration form, request, notice or some other printed and/or electronic documents and forms submitted by data subjects, such as panel members, employees and clients, among others;
2. Referral information, inquiry or post from data subjects and panel members, among others;
3. From subsidiaries, affiliates or clients, subject to permissible data sharing/outsourcing under applicable laws and/or other printed or electronic documents/materials submitted to us or publicly available; and
4. Data that may be collected directly by our subsidiaries, affiliates or clients through data gathering tools, such as survey links where data subjects are re-directed to the respective websites of these subsidiaries, affiliates or clients, further that said data are also subjected to the respective data privacy policies of said subsidiaries, affiliates or clients.

 

The data we collect from our data subjects includes the following:

1. First and Last Name
2. Username and Password
3. Email Address
4. Address – Region, Province or City of residence
5. Contact Number
6. Gender
7. Civil Status
8. Birthdate
9. Educational Attainment
10. Occupation
11. Employment Status
12. Average Monthly Income
13. Such other data directly connected, necessary or incidental to specific study, research, survey, polls and to the conduct of our business and services, among others.

 

Sharing and Disclosure

STRAND-Asia shall treat and keep all data collected strictly confidential, not intended for public disclosure, except upon lawful request of governmental authority, court order, and such other competent authorities or as required by law.

Data sharing or disclosure of the data that were provided to us are necessitated by various reasons and circumstances. We ensure that data protection and confidentiality are maintained upon sharing and disclosure of said data. Further, that DPA and other applicable laws are fully complied with.

We shall share the data we collected with our subsidiaries, affiliates or clients, as necessary, in compliance with contractual obligations, to outsource its processing and/or analysis, for research, upon the expressed consent and authority of concerned individuals, and for such other legitimate purposes permissible under applicable laws.

Storage, Security, Retention and Disposal

The storage of all data collected by STRAND-Asia through SurveyReal are outsourced to QuestionPro which are stored and maintained with strict confidentiality pursuant to DPA and the Data Retention Policy, Privacy Policy and Data Security of QuestionPro. Necessary, protection against accidental, unlawful and unauthorized access, destruction, alteration, disclosure, sharing and processing are in place to prevent any untoward incidents.

Generally, all data collected shall be retained indefinitely as necessary or until the purposes for which said data were collected are achieved. The period of retention may be changed without prior notice, depending on pertinent company policies, necessities or pursuant to applicable laws. Additionally, all data that are deleted and removed by data subjects are simultaneously deleted and removed permanently at QuestionPro’s US Data Center in Seattle, Washington, USA where said data are being retained.

All data collected shall be properly and securely disposed by authorized officer/s or employee/s of STRAND-Asia through any practicable means, such as shredding, deletion of electronic data and/or destroying or formatting of storage media. 

Rights of Data Subjects

STRAND-Asia recognizes and respects the right of data subjects to be informed, to access, to correct or rectify, to erasure or blocking, and to object to the processing, as well as the right to damages and to file a complaint before the National Privacy Commission, as provided under the DPA.

All inquiries and concerns pertaining to data we collect and our Privacy Policy, such as access to information, correction or rectification of data, erasure or blocking, as well as to report any actual or suspected data breaches or security incidents, among others, may be addressed to STRAND-Asia’s Data Privacy Office by providing complete details thereof:
